Overview

Please read this Privacy Policy carefully. You, the User of a Challenge Club product or service (“You”, “Your”, the “User”), agree to accept this Challenge Club Privacy Policy (the “Privacy Policy”) by explicitly selecting the affirmation method (e.g. clicking a button that says “I agree”, “I accept”, etc.) at the end of the Terms of Use, or making use of Challenge Club (also ”Challenge Club”, “we”, “our”, “us”, and other such first-person pronouns) products or services, including the Challenge Club website, any associated mobile application, and our Application Programming Interface ("API") (collectively, the “Site”), including any associated text, images, audio, code, or other material (the “Content”) (collectively our “Products”), or otherwise participating in a Challenge as defined in the Terms of Use.

It is important that you understand what we will and will not do with the information provided to us by Users through our Products. This Privacy Policy outlines the manner in which we collect information, how we use it, and any circumstances in which we may disclose it. By accepting the Privacy Policy, you expressly consent to our use and disclosure of your personal information as described herein. If our Privacy Policy is updated, we will provide notification on the front page of our Site, and in any other manner we deem appropriate, at our sole discretion, that is reasonably intended to provide adequate notice to Users.

Cookies

We use cookies in a variety of ways, which we will outline below. Before we do so, though, it's worth noting that we don't think cookies are inherently bad. A cookie is an object that stores text information about a User, such as a User"s login state, preferences, or methods of interacting with Challenge Club. Some of them are necessary for a particular site to function, such as cookies for a commerce website that store the contents of a User's cart or cookies that we use to authenticate and log in Users. Other cookies may collect and provide statistics about how Users interact with Challenge Club, which help us improve existing products and develop new products. We do not currently (or have any plans to) use marketing cookies, but these are cookies that may track your online activity to help advertisers manage ads that are displayed to You. Some cookies may remember a User"s preferences with respect to how a site (i.e. Challenge Club) looks or behaves.

Cookies are part of the mechanism by which a site, such as Challenge Club, manages necessary information about how you use its product, remembers your preferences, and is able to suggest and develop things that you may want to see and use. Certainly, cookies can be problematic, but, like many sites, we strongly believe that the benefits to Users and to us, which includes remembering User preferences and providing statistics which we can analyze to provide a better product, outweigh the potential downsides.

We do use necessary cookies, and may use preference cookies and statistics cookies. The necessary cookies that we use help us manage the User authentication and login processes, as well as story privacy settings. We may use preference cookies to manage your preferences, such as those related to the kinds of challenges that you prefer. We may also use statistics cookies (which, with respect to how we use this cookie, may also be called "analytics" or "performance" cookies) to understand the behavior of our Users in order to refine, expand, and develop products. We do not use marketing cookies designed to operate, serve, and/or track advertisements on our platform. It is possible that Challenge Club may eventually have multiple products across sites, and use marketing cookies to cross-promote our products, but we do not currently, or have any plans to, do so. We also do not currently have, or have any plans to add, third-party advertisements on the Challenge Club site. We may use embedded content from third-parties, such as video streams or social media interactions (e.g. a Facebook "like" button). While these would not involve Challenge Club setting any associated cookies, the origin site may set their own cookies. If you are a registered User, you may go to your account settings to customize your cookie preferences. We do not set cookies prior to you beginning the process of registering an account. You may set your cookie preferences at that time, and change them from your account settings dashboard [here][Cookie Customization Dashboard]. Whether or not you are a registered User, you may also generally manage your cookie settings through your browser.

Correspondences with Challenge Club

Correspondences with Challenge Club, including but not limited to emails, letters, and texts, may be retained. We may retain these records in order to improve customer service, investigate possible fraud, criminal activities, or violations of our Terms of Service, and otherwise protect our Users, Products, and legal interests.

Personal Information Collection

We request only the information needed to administer and provide customers with our Products, as solely determined by us. We may collect an array of "Personal Information" from you. When Users participate in a Challenge, they will be asked to provide their names, e-mail addresses, and third-party payment provider information as defined in our Terms of Use. They may also be asked to provide other contact information, such as a telephone number or physical address. We may also ask Users for information about third-party accounts, such as accounts with social media platforms like Facebook or Twitter, which we may use to help administer or improve our Products, such as identifying possible Challenges which a User might enjoy.

In order to comply with federal and state laws, banking, privacy, or other regulations, and/or other guidelines to minimize risk and authenticate a User"s identity, We may require you to provide additional information in order to verify your identity or contact information. We may also obtain information from you through surveys and other means, through which we may collect information about you and your preferences.

Personal Information Sharing

We will not give, sell, rent, or share your direct Personal Information to other parties for their marketing purposes. We may share your Personal Information to validate your identity. To the extent that your use of our Products involves a third-party, such as PayPal, we may share your Personal Information with that third-party to the extent that it is necessary for the third-party to provide its services. Third parties will not be authorized to use your personal information except for the purpose of providing those services. Any information obtained from third-parties and linked with your personal information is safeguarded by confidentiality agreements and to the extent required by law.

We may share Personal Information if we believe that it is necessary to cooperate with regulators or law enforcement authorities, or if there is a similar legal request, including the protection of our rights or the rights of other Users. If You object to the sharing of your Personal Information as described in this Privacy Policy, please do not use our Products.

From time to time, we may create, sponsor, or otherwise endorse a research study into which You may opt-in. If You choose to opt into such a study, You are authorizing us to provide the personal information needed for the study.

As noted in our Terms of Service, We own all rights in and to any content created by Users as part of the direct use of our Products, including but not limited to the terms of a Challenge, its resolution criteria, and the relationships among participants, and between participants and the Challenges themselves. We may analyze and use this information for our own business purposes, or sell or otherwise transfer analysis of this information to third-parties. We will only do this with information that has been sanitized so that it does not contain direct Personal Information. On other words, we may analyze and sell information about our Products, but only if that information does not contain Personal Information such as a User"s name or e-mail address.

Outside Links

Through the use of our Products, You may come across links to other sites, including links provided by other Users as part of a Challenge. Any links posted in this way are wholly the responsibility of the party who posted them. We are not responsible for the content or privacy practices of any such sites. As a general rule of good internet hygiene, please read any privacy statements associated with those sites carefully, and be aware of how they collect personally identifiable information. This Privacy Policy applies solely to your experiences with our Products.

Data Access and Security

We recognize that we may have sensitive Personal Information from You, and we will make reasonable efforts to ensure the security of your Personal Information on our systems. Despite our efforts, however, we cannot guarantee that Personal Information may not be accessed, disclosed, altered, or destroyed by breach of our administrative, managerial, and technical safeguards. If We learn of a security breach we may attempt to notify affected Users electronically so that they can take appropriate protective steps. By using our Products, You agree that We may communicate with You electronically. We may also post a notice on our Site in the event of a security breach, or send You an e-mail message. Depending on where You live, You may also have a legal right to receive notice of a security breach in writing. Merger or Sale

In the event of a change of ownership control over Challenge Club, information collected by us will be treated as an asset, and may be transferred except to the extent the law may prohibit such transfers.

Notification of Changes

This Privacy Policy may change. When We make changes, We will revise the effective date on the Privacy Policy accordingly, and notify Users within a reasonable period of time. However, You should regularly check our user-related documents, such as our Privacy Policy and Terms of Service, to remain apprised of their contents. your continued use of our Products following a change in our Privacy Policy constitutes assent to those changes.
